1.1 In these Terms and Conditions, the following expressions have the meanings set out below:

b. Customer, you, your: The individual or business requesting and paying for the services.
c. Services: Any rubbish removal, waste collection, loading, transportation, and related services provided by us.
d. Premises: The property or location from which waste is to be collected.
e. Waste: Any rubbish, refuse, junk, or other materials agreed to be collected as part of the Services, subject to applicable waste regulations and exclusions.
2.1 We provide rubbish removal and waste collection services for domestic and commercial customers. This may include collection of general household waste, garden waste, bulky items, and certain types of commercial waste, providing it complies with applicable regulations.
2.2 The specific scope of the Services, including the type and approximate volume of waste to be collected, the collection date, and the price, will be agreed with you at the time of booking.
2.3 We reserve the right to refuse to collect any waste that:
a. is hazardous, toxic, explosive, or otherwise dangerous;
b. is prohibited by law or by relevant waste regulations;
c. is materially different in nature or volume from what was described by you at the time of booking.
2.4 If we attend the Premises and the waste is significantly more than, or different from, what was described, we may:
a. offer to carry out the Service at an adjusted price, to be confirmed with you before work continues; or
b. refuse to carry out all or part of the Service and charge a call-out or cancellation fee as set out in these Terms and Conditions.
3.1 You may request a booking for rubbish removal by telephone, email, online form, or any other method we make available.
3.2 When making a booking, you must provide accurate information, including:
a. your full name and contact details;
b. the address of the Premises where the collection is to take place;
c. a description and approximate volume or weight of the waste to be collected;
d. details of access to the Premises, including stairs, lifts, parking restrictions, and any potential access issues;
e. your preferred collection date and time window.
3.3 Any price quotation provided is based on the information you supply. If that information is incomplete or inaccurate, the final price may change.
3.4 A booking is only confirmed once we have:
a. accepted your request;
b. provided confirmation of the collection date, time window, and estimated charge; and
c. where required, received any deposit or prepayment from you.
3.5 We will use reasonable efforts to arrive within the agreed time window, but this cannot be guaranteed. Times are estimates only and may be affected by traffic, weather, access issues, or other events beyond our reasonable control.
4.1 You must ensure that we have safe, reasonable, and timely access to the Premises and to the waste to be collected.
4.2 You must ensure that:
a. the waste is clearly identified and separated from items not to be removed;
b. there are no health and safety risks that you have not disclosed in advance;
c. any required permissions, permits, or authorisations from a landlord, local authority, or managing agent are in place prior to the collection.
4.3 If we are unable to access the Premises or the waste due to your act or omission, we may charge a wasted journey fee or cancellation fee.
5.1 Our charges are based on factors such as the volume and weight of waste, the type of materials, the time taken to load, access conditions, and any disposal fees.
5.2 An estimated price or price range may be given at the time of booking based on your description of the waste. The final price will be confirmed once our team has inspected the waste on site, before loading begins.
5.3 All prices are stated in pounds sterling and may be inclusive or exclusive of VAT, which will be made clear at the time of quotation.
5.4 Unless otherwise agreed in writing, payment is due immediately upon completion of the Service and prior to our team leaving the Premises.
5.5 We may accept payment by cash, debit or credit card, bank transfer, or other methods specified by us from time to time. You authorise us to take payment using the agreed method when the final price has been confirmed.
5.6 If payment is not made when due, we reserve the right to:
a. charge interest on overdue sums at the statutory rate;
b. recover from you all costs and expenses incurred in enforcing payment, including legal and debt recovery costs;
c. suspend or cancel any future bookings.
6.1 You may cancel or amend your booking by contacting us during our normal working hours.
6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless a specific non-refundable deposit has been agreed in advance.
6.3 If you cancel less than 24 hours before the scheduled collection time, fail to provide access, or are not present when required, we may charge a cancellation or wasted journey fee to cover our costs.
6.4 We reserve the right to cancel or amend any booking at any time due to circumstances beyond our reasonable control, including but not limited to severe weather, traffic incidents, vehicle breakdown, staff illness, or legal restrictions. In such cases, we will contact you as soon as reasonably practicable to arrange an alternative time. We will not be liable for any loss you may incur as a result of such cancellation or delay.
7.1 We operate in accordance with applicable UK waste management legislation and regulations.
7.2 We will only collect waste that we are licensed and permitted to handle. Certain items are strictly prohibited or may require special arrangements, including but not limited to:
a. asbestos or materials containing asbestos;
b. chemicals, solvents, paints, and oils;
c. clinical or medical waste, sharps, and biological materials;
d. gas cylinders and pressurised containers;
e. explosives, firearms, and ammunition;
f. radioactive materials;
g. large quantities of electrical or electronic equipment requiring specialist disposal, unless specifically agreed in advance.
7.3 If you present prohibited items for collection without prior written agreement, we may refuse to remove them and may charge an additional fee for any time spent dealing with them.
7.4 By booking the Services, you confirm that the waste to be collected does not include hazardous or prohibited items, unless we have expressly agreed in writing to handle such materials.
7.5 Once collected, we will transport and dispose of waste using authorised facilities and in accordance with relevant regulations and duty of care requirements.
8.1 Ownership of waste transfers to us once it has been loaded onto our vehicle and payment has been or will be made in accordance with these Terms and Conditions.
8.2 Risk of loss or damage to the waste passes to us once it has been loaded onto our vehicle. Until that point, the waste remains at your risk, and you are responsible for its safe storage.
9.1 We will exercise reasonable care and skill when providing the Services.
9.2 We will not be liable for:
a. normal wear and tear or minor cosmetic damage that may reasonably occur in the course of removing bulky items from the Premises;
b. any damage arising from pre-existing structural defects, weaknesses, or poor condition of property, fixtures, or fittings;
c. loss or damage resulting from inaccurate or incomplete information provided by you;
d. any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity.
9.3 You must notify us in writing of any alleged loss or damage as soon as reasonably practicable and in any event within 7 days of the Service being carried out. We may inspect the damage and request evidence before considering any claim.
9.4 Nothing in these Terms and Conditions shall limit or exclude our liability for:
a. death or personal injury caused by our negligence;
b. fraud or fraudulent misrepresentation; or
c. any other liability which cannot be limited or excluded by law.
9.5 Subject to the above, our total liability to you arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable for the specific Service giving rise to the claim.
10.1 You are responsible for ensuring that the waste to be collected belongs to you or that you have full authority from the owner to dispose of it.
10.2 You agree to indemnify us in full against any claims, losses, liabilities, damages, costs, or expenses arising from:
a. any breach by you of these Terms and Conditions;
b. any claim by a third party alleging that the waste did not belong to you or that you had no right to dispose of it;
c. any fines or penalties imposed on us as a result of your failure to disclose the nature of the waste or your provision of inaccurate information.
11.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing your name, address, booking details, and the nature of your complaint.
11.2 We will investigate your complaint and aim to respond within a reasonable timeframe. We may request additional information or evidence to assist our investigation.
12.1 We shall not be in breach of these Terms and Conditions, nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control. This may include, but is not limited to, extreme weather, traffic disruption, accidents, fire, flood, strike, labour dispute, or changes in law or regulation.

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
